PAIA Manual

1. Introduction
The Promotion of Access to Information Act, No. 2 of 2000 (“PAIA”) gives effect to the constitutional right of access to information held by the State and by private bodies where that information is required for the exercise or protection of any rights. This manual is published in terms of Section 51 of PAIA to assist any person who wishes to request access to records held by the Company.

3. Guide on How to Use PAIA
The Information Regulator has published a Guide on how to use PAIA, available in each official language. 4. Records Available Without a Formal Request
- Information published on our website, med-staff-solutions.com.
- Marketing and promotional material describing our recruitment services.
- Our Privacy Policy.
5. Categories of Records Held
We hold records relating to: business and statutory records; candidate records (CVs, applications, qualifications, references); client and practice records (vacancy briefs and correspondence); financial records; and employment and internal records. Access is considered in accordance with PAIA and is not automatic.

7. How to Request Access to a Record
- Complete the prescribed request form (Form 2 – Request for Access to Record of Private Body) and submit it to the Information Officer.
- Provide enough detail to identify the record and requester, the form of access required, and contact details.
- Identify the right you seek to exercise or protect and why the record is required.
- Pay the prescribed request fee before the request is processed; an access fee may also apply before records are released.
- We will endeavour to respond within 30 days, as provided for in PAIA.
8. Fees
A request fee and, where applicable, an access fee are payable in accordance with the fees prescribed in the Regulations under PAIA. Prescribed amounts are subject to change and should be confirmed at the time of the request.
9. Grounds for Refusal of Access
Access may be refused on the grounds set out in Chapter 4 of Part 3 of PAIA, including the mandatory protection of the privacy of a third party, the protection of commercial and confidential information, records privileged in legal proceedings, and the protection of the safety of individuals and property.
10. Remedies if a Request is Refused
A requester may lodge a complaint with the Information Regulator in the prescribed manner and within the prescribed period, and/or apply to a court with jurisdiction for appropriate relief after exhausting any internal remedies.

This manual is available on this website, at our premises on request during office hours, from the Information Regulator, and on request from the Information Officer.
